Workplace rules versus contract text

Companies love handbooks. Apprentices receive dress codes, device policies, and cafeteria rules in the same onboarding packet as the Ausbildungsvertrag. Confusion starts when the packet implies every page carries equal legal weight.

Contract first

The signed training agreement — plus mandatory law and any applicable collective agreement — frames the relationship. Handbooks can detail how the company implements those frames. They should not quietly shorten vacation below what the contract states, or invent repayment duties never mentioned at signing.

Healthy references

Good contracts say that certain operational details appear in a policy the apprentice receives before day one. That transparency is useful. Problematic drafts bury material obligations only in a PDF that changes without notice.

What we do in sessions

During Agreement Deep Dives we mark every cross-reference from contract to handbook. If the handbook is unavailable, we list it as an open item rather than pretending the review is complete. That limitation frustrates some clients — and it is more honest than rubber-stamping a partial file.
