Probation clauses through a trainee’s eyes

Probezeit feels abstract until someone mentions ending the relationship with short notice. Trainees often hear myths: that probation means unpaid overtime is expected, or that any mistake triggers instant dismissal. Contract text is usually narrower than hallway stories.

What the clause typically sets

Length, mutual notice, and the fact that ordinary protection rules may apply differently during this window. It does not rewrite health and safety duties, and it does not authorize harassment “because you are still on probation.”

Questions worth asking early

  • Is the Probezeit stated in months or calendar days, and does it pause for long absences?
  • What notice applies if either side ends the contract during that period?
  • Does any amendment after signing restart probation? (Often no — but check the wording.)

When to escalate
